Jersey Property App Legal

This page sets out the Privacy Policy and Terms of Use for the Jersey Property App, developed and operated by Raven Consultancy and available on the Apple App Store and Google Play. Please read both documents before using the App.

This Privacy Policy explains what personal information Raven Consultancy collects through the Jersey Property App ("App"), how we use it, who we share it with, and your rights under applicable data protection law, including the Data Protection (Jersey) Law 2018 and, where relevant, the UK/EU GDPR.

1. Who we are

The Jersey Property App is developed and operated by Raven Consultancy, based in Jersey, Channel Islands. We are the data controller for personal data collected through the App.

2. Scope

This policy covers both the iOS version (distributed via the Apple App Store) and the Android version (distributed via Google Play). The two apps share the same cloud backend, so the data we collect and how we use it is the same on both platforms, except where a specific platform service is noted below.

3. What data we collect

3.1 Account information

  • Email address and display name
  • Password — handled and stored in encrypted form by Firebase Authentication; we never see or store your plain-text password
  • If you choose to sign in with Google Sign-In or Sign in with Apple, we receive your name and email address (or Apple's private relay email, if you choose to hide your address) to create your account

3.2 Profile details

  • Phone number (optional, used for property enquiries)
  • Account type (private owner or agency)
  • For agency accounts: agency name and agency logo image
  • Profile photo, if you add one

3.3 Property listing content

If you create a listing, we collect the photographs, description, address, asking price, and related property details you submit. This content is displayed publicly within the App.

3.4 Messages and enquiries

The content of property enquiries, viewing requests, and chat messages you send through the App is stored on our cloud servers (Firebase Firestore) so that conversations sync between you and the other party.

3.5 Mortgage and viewing enquiries

If you send a mortgage or availability enquiry, we collect the name, email address, phone number, and message you provide, together with the related property details, in order to deliver your enquiry.

3.6 Photos and media

With your permission, the App accesses photos you select from your device's library — only the images you actively choose to upload for a listing or profile. We do not access your wider photo library.

3.7 Push notification token

With your permission, a device push token (provided by Apple Push Notification service on iOS, or Firebase Cloud Messaging on Android) is generated and stored securely on our servers so we can send you enquiry responses, new-message alerts, and property alerts you have opted into. You can disable notifications at any time in your device Settings or within the App.

3.8 Usage and analytics data

We use Firebase Analytics (Google LLC) to understand how the App is used. This includes anonymous usage events such as viewing a property, creating a listing, and search terms entered, along with standard technical data (device type, operating system version, App version, and session information). On Android we also use Firebase Crashlytics to collect crash diagnostics so we can fix bugs.

3.9 Favourites

Properties you save as favourites are stored locally on your device and are not transmitted to our servers.

3.10 Data we do not collect

  • Location: the App does not collect your device's GPS or network location. The map displays properties using the coordinates attached to each listing only.
  • Advertising identifiers: we do not use advertising IDs (IDFA/AAID), and the App contains no third-party advertising or ad tracking.
  • We do not collect payment or financial card details through the App.

4. How we use your data

  • To create and manage your account and authenticate sign-in
  • To display property listings and deliver search results
  • To facilitate enquiries and messaging between buyers, renters, listers, and agencies
  • To send transactional emails and push notifications (e.g. enquiry confirmations, message alerts, account updates)
  • To operate, improve, secure, and debug the App
  • To comply with our legal obligations

We do not sell your personal data to third parties, and we do not use your data for unsolicited marketing without your consent.

5. Legal basis for processing

Under the Data Protection (Jersey) Law 2018 we rely on the following bases:

  • Performance of a contract — to provide the App's core features to you
  • Legitimate interests — to improve the App, prevent fraud, and maintain security
  • Consent — for push notifications, photo library access, and optional communications (which you may withdraw at any time)
  • Legal obligation — where required by Jersey law

6. Third-party services and data sharing

We use the following trusted service providers, each governed by their own privacy policy:

  • Firebase (Google LLC) — authentication, cloud database (Firestore), file storage (photos), push messaging (FCM), analytics, and crash reporting. See Google's Privacy Policy.
  • Google Sign-In — optional sign-in with your Google account.
  • Sign in with Apple — optional sign-in with your Apple ID (iOS). See Apple's Privacy Policy.
  • Apple Maps / MapKit (iOS) and Google Maps (Android) — used to display the property map.
  • Email delivery (Google Gmail and Resend) — used to deliver enquiry and account-related administrative emails. Details you include in an enquiry are processed solely to deliver the message.

International transfers. Some of these providers process data on servers outside Jersey, including in the United States. Where data is transferred internationally, it is protected by appropriate safeguards such as standard contractual clauses and the providers' own compliance frameworks.

7. Data retention

We retain your account data for as long as your account is active. If you delete your account (see section 9), we erase your personal data within 30 days, except where retention is required by law. Listings and messages associated with a deleted account are removed or anonymised.

8. Data security

We apply industry-standard security measures, including HTTPS/TLS encryption for data in transit, encrypted password storage, server-side access controls, and Firebase App Check to help ensure that only genuine copies of our App can access our backend. No system is entirely secure, and we cannot guarantee absolute security.

9. Account deletion & your choices

You are in control of your data:

  • Delete your account in the App: go to Account → Delete Account. This permanently removes your profile, listings, and messages, subject to the retention rule above.
  • Request deletion by email: you can also email admin@raven-consultancy.com with the subject line "Data Deletion — [your name]" and we will action it within 30 days.
  • Notifications: manage or turn off push notifications in the App's notification settings or your device Settings.
  • Photo access: you can revoke photo library access at any time in your device Settings.

10. Your rights

Under Jersey data protection law you have the right to access, rectify, erase, restrict, port, and object to the processing of your personal data, and to withdraw consent at any time. To exercise these rights, contact admin@raven-consultancy.com; we will respond within 30 days.

You may also lodge a complaint with the Jersey Office of the Information Commissioner (JOIC).

11. Children's privacy

The App is intended for adults and is not directed at children. You must be at least 18 years old to create an account. We do not knowingly collect personal data from children. If you believe a child has provided us with their data, please contact us and we will delete it.

12. Changes to this policy

We may update this Privacy Policy from time to time. When we make material changes, we will notify you via the App or by email and update the "Last updated" date above. Continued use of the App after changes take effect constitutes acceptance of the updated policy.

Please read these Terms carefully. By creating an account or using the Jersey Property App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Acceptance of terms

These Terms of Use ("Terms") govern your access to and use of the Jersey Property App ("App") provided by Raven Consultancy ("we", "us", "our"). By downloading or using the App, you confirm that you are at least 18 years of age and have the legal capacity to enter into this agreement.

2. Description of service

The Jersey Property App is a property search and listing platform for the Jersey, Channel Islands property market. The App allows users to:

  • Search, browse, and save residential and commercial property listings
  • Create and publish property listings for sale or rent
  • Contact agencies and private listers, and exchange messages through the App
  • Use a map-based view (powered by Apple Maps on iOS and Google Maps on Android) and a mortgage calculator

We do not act as an estate agent, solicitor, surveyor, or financial adviser. The App is an information and communication platform only.

3. User accounts

To access full functionality you must register an account. You agree to:

  • Provide accurate, complete, and current information
  • Keep your password confidential and not share it
  • Notify us immediately of any unauthorised use of your account
  • Take responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Property listings

If you publish a listing, you confirm that:

  • You are the owner of the property or have legal authority to list it
  • All information (price, description, photos, location) is accurate and not misleading
  • The listing complies with all applicable Jersey laws, including the Control of Housing and Work (Jersey) Law 2012
  • You will respond to genuine enquiries in a timely manner

Private owners may be subject to a limit on the number of simultaneously active listings; agency accounts are unlimited. We reserve the right to remove listings we reasonably believe to be fraudulent, inaccurate, or in breach of these Terms, without prior notice.

5. Acceptable use and user content

You are solely responsible for the content you submit (listings, photos, messages, and enquiries). You agree not to use the App to:

  • Post false, misleading, or fraudulent listings
  • Post content that is unlawful, defamatory, obscene, harassing, hateful, or otherwise objectionable
  • Harass, abuse, threaten, or harm other users
  • Scrape, copy, or reproduce content from the App without our written permission
  • Attempt to gain unauthorised access to our systems, or transmit spam, malware, or harmful code
  • Use the App for any unlawful purpose or in violation of Jersey law

Zero tolerance for objectionable content and abusive behaviour. Because the App allows user-generated content and direct messaging, we operate a zero-tolerance policy for objectionable content and abuse. Within the App you can:

  • Report or flag any listing, message, or user you consider objectionable;
  • Block a user so they can no longer contact you.

We review reports and will remove offending content and remove the user who provided it within 24 hours where a report is upheld. You can also contact us at admin@raven-consultancy.com to report content or behaviour.

6. Intellectual property

All content, trademarks, logos, and software within the App are the property of Raven Consultancy or our licensors. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes only.

By submitting content (such as property photos or descriptions), you grant us a non-exclusive, royalty-free licence to host, display, and reproduce that content within the App for the purpose of operating and promoting the service. You retain ownership of your content.

7. Disclaimers

The App is provided on an "as is" and "as available" basis. We do not warrant that:

  • Property information listed by third parties is accurate or complete
  • The App will be uninterrupted, error-free, or free from viruses
  • Search results will meet your specific requirements

We strongly recommend that you carry out your own due diligence and seek independent legal and financial advice before entering into any property transaction.

8. Limitation of liability

To the fullest extent permitted by Jersey law, Raven Consultancy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the App, including loss of data, loss of profits, or property transaction losses.

Our total liability to you shall not exceed the amount you have paid to us in the 12 months preceding the claim (or £100 if you have paid nothing).

9. Third-party links and services

The App may contain links to third-party websites or services (including agencies and solicitors). We are not responsible for the content, privacy practices, or accuracy of third-party services, and use of them is at your own risk.

10. Termination

You may delete your account at any time via Account → Delete Account. We may suspend or terminate your access immediately if you breach these Terms. On termination, your right to use the App ceases immediately.

11. App Store — additional terms

The following terms apply when you download the App from the Apple App Store, and you acknowledge them as required by Apple:

  • These Terms are between you and Raven Consultancy only, and not with Apple. Apple is not responsible for the App or its content.
  • Apple has no obligation to provide maintenance or support for the App. Any support requests should be directed to us at admin@raven-consultancy.com.
  • In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation.
  • Apple is not responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, or consumer protection claims.
  • Apple is not responsible for the investigation, defence, settlement, or discharge of any third-party intellectual property infringement claim relating to the App.
  • You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

When you download the App from Google Play, your use is also subject to the Google Play Terms of Service.

12. Governing law

These Terms are governed by the laws of Jersey, Channel Islands. Any disputes are subject to the exclusive jurisdiction of the Royal Court of Jersey.

13. Changes to these Terms

We may revise these Terms at any time and will give notice of material changes via the App or by email. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
